Terms of Service
Last updated: 7 October 2026
1. Overview
Welcome to FungiGlow.
These Terms of Service (“Terms”) govern your use of our website, online store, products and related services.
The terms “we”, “us” and “our” refer to FungiGlow Ltd.
Our store is powered by Shopify, which provides the ecommerce platform that allows us to sell our products and services to you.
By accessing or using our website, creating an account or placing an order, you agree to be bound by these Terms together with our Privacy Policy, Returns & Refunds Policy and any other policies referenced on our website.
If you do not agree to these Terms, you should not use our website or Services.
Nothing in these Terms affects your statutory rights as a consumer.
2. About us
FungiGlow is operated by:
FungiGlow Ltd
Registered in England and Wales
Company number: 16469369
Email: info@fungiglow.com
Our registered/business address is displayed on our website and in accordance with applicable UK company and ecommerce requirements.
If we become VAT registered, our VAT registration details will be displayed where required.
3. Using our website
You may use our website only for lawful purposes.
You agree not to:
- misuse, interfere with or attempt to disrupt the website or its security;
- introduce viruses, malware or other harmful material;
- attempt to gain unauthorised access to the website, servers or accounts;
- use the website for fraudulent, unlawful or abusive purposes;
- scrape, reproduce or exploit website content without permission, except where permitted by law;
- infringe our intellectual property rights or those of any third party;
- impersonate another person or provide false or misleading information.
We may suspend or restrict access to our website where we reasonably believe these Terms have been breached.
4. Accounts
You may be asked to create an account or provide certain information when placing an order.
You are responsible for ensuring that the information you provide is accurate, current and complete.
You are also responsible for keeping your login details secure and for activity carried out through your account.
Please contact us promptly if you believe your account has been compromised.
5. Our products
We aim to describe and display our products as accurately as possible.
However, product colours, packaging and appearance may vary slightly from images displayed on your device.
We may update product packaging, ingredients, presentation or other product details from time to time, provided this does not materially reduce the quality or nature of the product purchased.
We reserve the right to discontinue products or limit quantities available for purchase.
All goods supplied to UK consumers remain subject to applicable statutory rights, including requirements that goods are of satisfactory quality, fit for purpose and as described. Legislation.gov.uk
6. Health and wellness information
FungiGlow products are wellness products and are not medicines.
Any information provided on our website, social media, packaging, marketing materials or other channels is provided for general informational and educational purposes only.
It is not intended to be a substitute for professional medical advice, diagnosis or treatment.
Our products are not intended to diagnose, treat, cure or prevent disease.
You should seek appropriate medical advice if you are pregnant, breastfeeding, taking medication, have an existing medical condition, are undergoing medical treatment or have concerns about whether a product is suitable for you.
Always read the product label and follow the recommended usage instructions.
Nothing in this section limits any responsibility we have under applicable consumer protection or product safety law.
7. Orders
When you place an order through our website, you are making an offer to purchase the products in your basket.
Receipt of an order confirmation does not necessarily mean that your order has been accepted.
A contract between you and FungiGlow is formed when we confirm that your order has been accepted and/or dispatched.
We may decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- there is an obvious pricing or description error;
- payment has not been authorised;
- we suspect fraud or misuse;
- delivery cannot reasonably be completed to the address provided.
If we cancel an order after payment has been taken, we will refund the amount paid.
Please review your order carefully before submitting it.
Your cancellation and return rights are explained in our Returns & Refunds Policy.
Nothing in these Terms limits your statutory cancellation or consumer rights.
8. Prices and payment
Prices displayed on our website are the prices payable at the time you place your order, unless an obvious error has occurred.
Where required, consumer-facing prices will include applicable taxes.
Any delivery charges will be clearly displayed before you complete your purchase.
UK distance-selling rules require online sellers to provide consumers with key information before purchase, including the business identity, total price including taxes, delivery arrangements and relevant cancellation rights. GOV.UK
You agree to provide accurate payment and billing information.
Payment must be authorised before an order can be processed.
We may offer promotions or discount codes from time to time. Additional terms may apply to individual promotions.
9. Shipping and delivery
We will provide estimated delivery times and applicable delivery charges during checkout or elsewhere on our website.
Delivery dates are estimates unless we expressly agree otherwise.
We are not responsible for delays caused by circumstances genuinely outside our reasonable control, but this does not affect your statutory rights.
For consumer orders, responsibility for the goods does not simply transfer to you when we hand them to the courier. Applicable consumer law continues to govern delivery and risk.
Where UK distance-selling rules apply, the cancellation period for most goods runs for 14 days after the goods come into the physical possession of the consumer or another person nominated by them, other than the carrier. Legislation.gov.uk
Please contact us at info@fungiglow.com if your order has not arrived within the expected timeframe.
10. Returns, cancellations and refunds
Our voluntary returns policy is set out in our Returns & Refunds Policy.
For eligible UK online purchases, consumers generally have the right to cancel within 14 days after receiving the goods, subject to applicable exceptions. Legislation.gov.uk
Certain sealed goods may lose the statutory cancellation right once unsealed where they are unsuitable for return for health protection or hygiene reasons.
Our voluntary 30-day returns policy does not replace or restrict your statutory rights.
Where goods are faulty, damaged, not as described or otherwise fail to meet your statutory rights, remedies under UK consumer law may apply.
We cannot exclude or restrict statutory rights relating to matters such as satisfactory quality, fitness for purpose and goods being as described. Legislation.gov.uk
11. Pre-orders
Where a product is offered on a pre-order basis, the estimated dispatch or delivery timeframe will be stated on the relevant product page or during checkout.
Pre-order dates are estimates and may change due to production, supply or logistics circumstances.
If a material delay occurs, we will provide updated information where reasonably possible.
Your statutory cancellation and refund rights continue to apply.
12. Intellectual property
Unless otherwise stated, all content on the FungiGlow website, including our:
- name;
- logos;
- branding;
- product names;
- artwork;
- graphics;
- photography;
- video;
- written content;
- website design; and
- other original materials
is owned by or licensed to FungiGlow Ltd and is protected by applicable intellectual property laws.
You may use our website and its content for personal, non-commercial purposes only.
You must not copy, reproduce, modify, distribute, sell, commercially exploit or create derivative works from our content without our prior written permission, except where permitted by law.
Third-party trademarks and intellectual property remain the property of their respective owners.
13. Artist collaborations and third-party content
From time to time, FungiGlow may collaborate with artists, creatives, partners or other third parties.
Intellectual property in collaborative works may belong to FungiGlow, the relevant creator or both, depending on the applicable agreement.
Purchasing a product featuring artwork or creative content does not transfer ownership of the underlying intellectual property unless expressly stated otherwise.
14. Third-party services and links
Our website may contain links to third-party websites, applications, payment providers, fulfilment partners or other services.
We are not responsible for the content, availability, privacy practices or terms of third-party websites or services that we do not control.
You should review the applicable terms and privacy policies before using third-party services.
15. Shopify
Our store is hosted by Shopify.
Shopify provides the ecommerce platform and technical infrastructure that enables us to provide our online store.
Any contract for the purchase of FungiGlow products is between you and FungiGlow Ltd, not Shopify.
Certain personal information may be processed by Shopify in accordance with Shopify’s own privacy practices and our Privacy Policy.
16. Privacy
We process personal information in accordance with our Privacy Policy and applicable data protection law.
Our Privacy Policy explains what information we collect, why we collect it, how it is used and your rights in relation to your personal information.
17. Reviews, feedback and user content
If you provide reviews, photographs, comments, suggestions or other content to FungiGlow, you confirm that you have the right to provide that content.
Where you submit content for publication, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content in connection with our business and marketing, unless otherwise agreed.
We will not knowingly use user-generated content in a misleading way.
We may remove content that is unlawful, abusive, misleading, defamatory, infringing or otherwise inappropriate.
18. Errors and inaccuracies
We make reasonable efforts to ensure information on our website is accurate.
Occasionally, errors may occur relating to:
- product descriptions;
- availability;
- pricing;
- promotions;
- shipping charges;
- delivery times; or
- other website information.
We may correct genuine errors when identified.
If an error affects an order you have already placed, we will contact you where appropriate and will not use this section to remove rights you have under consumer law.
19. Availability of the website
We do not guarantee that our website will always be available, uninterrupted or free from technical issues.
We may temporarily suspend or restrict access for maintenance, security, technical or operational reasons.
We will try to minimise disruption where reasonably possible.
20. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
This includes liability that cannot lawfully be excluded or restricted under applicable consumer protection law.
Nothing in these Terms affects your statutory rights.
Where permitted by law, we are not responsible for losses that:
- were not reasonably foreseeable when the contract was formed;
- result from your misuse of the website or products;
- result from inaccurate information you provide to us;
- arise from circumstances outside our reasonable control.
If you are using our products or website for business purposes rather than as a consumer, different rights and limitations may apply.
21. Events outside our control
We are not responsible for failure or delay in performing our obligations where caused by events outside our reasonable control.
This may include events such as:
- severe weather;
- transport disruption;
- industrial action;
- supply-chain interruption;
- natural disasters;
- government action;
- telecommunications failures; or
- other events we could not reasonably prevent.
Where such an event materially affects your order, we will try to keep you informed and your statutory rights will remain unaffected.
22. Termination and suspension
We may suspend or terminate access to our website where you materially breach these Terms or misuse our Services.
Termination does not affect rights or obligations that arose before termination.
Sections that by their nature are intended to continue after termination will remain in effect.
23. Severability
If any part of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.
24. No waiver
If we do not immediately enforce a right under these Terms, that does not mean we have waived that right.
25. Changes to these Terms
We may update these Terms from time to time to reflect changes to our business, Services, website or applicable law.
The latest version will always be published on this page.
Where required by law, we will provide appropriate notice of material changes.
Changes will not retrospectively remove rights you already have in relation to an existing order.
26. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom or another jurisdiction, you may also benefit from mandatory consumer protection rights that apply in the place where you live.
Nothing in these Terms is intended to prevent you from relying on those mandatory rights.
